SHIMANSKY VALENTINE COMPETITION 2025 TERMS AND CONDITIONS

Entrants are encouraged to thoroughly review the Competition terms and conditions. These terms and conditions are not intended to, and must not be interpreted as, unlawfully restricting, limiting, or avoiding any rights or obligations imposed on either the entrant or the organiser under the Consumer Protection Act, 68 of 2008 ("CPA").  

By entering the competition, the entrant confirms they have had sufficient opportunity to review these terms and conditions and fully understand and agree to comply with them.  

INDEMNITY

By participating in this competition, the entrant agrees to indemnify and hold harmless the organiser, My Light Holdings (Pty) Ltd t/a Shimansky, its affiliated entities, and their directors, employees, and agents from any and all liability for damages, costs, injuries, or losses of any kind incurred as a result of participation in the competition. The organiser is not liable for the safety, quality, or suitability of any prizes or activities provided by non-affiliated competition partners. The winner further agrees to indemnify and hold the organiser, its employees, agents, and affiliates harmless against any claims, liabilities, or actions arising from or related to the use or misuse of such prizes or participation in independent competition partner activities.

LIABILITY DISCLAIMER

The organiser is not affiliated with the independent competition partners in any way. The winner acknowledges that the independent competition partners are solely and fully responsible for the prizes they are sponsoring, including their delivery, quality, safety, and any associated warranties or obligations.

COMPETITION RULES

The Shimansky Valentine competition commences on 1 February 2025 at 01h00 and concludes on 13 February 2025 at midnight, after which no late entries received will be considered.

Only valid entries will be accepted. Unfollowing any of the pages before the competition concludes will result in disqualification. 

  • Prizes are supplied by the organiser and independent competition partners.  
  • Prizes are non-transferable. No substitution or assignment of prizes is permitted.  
  • The prizes will be made available for the winner to collect at their convenience and within the agreed upon time limits by the organiser and independent competition partners. Entrants must be available to accept their prizes in Cape Town. 

To be eligible for the competition, each entrant must fulfil the following requirements:  

  • Entrants must reside in South Africa. 
  • Entrants must provide correct and full personal details, as required.  
  • Entrants must be 18 years of age or older. 
  • By entering the competition, the entrant hereby warrants that all information submitted is true, current and complete.  

ELIGIBILITY CLAUSE

Employees, directors, agents, and immediate family members of the organiser and independent competition partners, as well as any affiliated entities, are not eligible to enter the competition.

SELECTION OF WINNERS

  • Winners will be named on 14 February 2025 (this date is subject to change without prior notice).  
  • Prize winners will be chosen through a random draw.  
  • The potential winner will be contacted either via email or telephonically on 14 February 2025 (this date is subject to change without prior notice).  
  • At the time of the call or email, the potential prize winner may be required to answer several questions about his/her eligibility. If a potential winner does not meet the eligibility requirements, the prize will be forfeited and awarded to another potential winner, the entry of whom will be randomly selected after a re-draw.  
  • The organiser may, in its sole discretion, decide whether a replacement should be selected. 
  • A potential prize winner is not an actual winner until his/her submission or entry is validated. In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited, and a re-draw will take place, subject to all existing competition terms and conditions.  
  • The organiser solely reserves the right to disqualify a winner if he/she does not respond to the email or telephone call, within 2 (two) working days. A replacement winner will therefore be randomly selected from all the competition entries. In these circumstances, the replacement winner shall be contacted via email or telephonically by the organiser as soon as reasonably practicable and shall be required to respond to the organiser in the manner set out in such correspondence. In the event that the replacement winner fails to respond to the organiser as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will take place.  
  • The organiser reserves the right to amend these terms and conditions or terminate the competition for valid reasons, such as unforeseen circumstances or legal requirements. Any amendments will be communicated to participants via the competition’s official platform(s) in advance, where feasible. Participants will not lose any accrued rights due to amendments made after their entry. In the event of such termination, all participants agree to waive any rights that they may have in terms of the competition and acknowledge that they will have no recourse against the organiser, its affiliated entities, and their directors, employees, agents and independent competition partners.  
  • The prizes shown may not accurately represent the actual prizes awarded, as the final selection will depend on availability and the sole discretion of the organiser and competition partner brands. In the event that a prize becomes unavailable due to circumstances beyond the organiser’s control, the organiser reserves the right to substitute the prize with an alternative of equal value. The organiser will notify the winner of such changes and provide full details about the substituted prize. 

GENERAL

  • By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the organiser to comply with its obligations under the CPA including, but not limited to:   
  • Providing such personal information as may be required to facilitate handing over the prize (including providing proof of address and identity number); and 
  • Signing receipt of the prize upon its delivery.  
  • The organiser is not responsible for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication line failures, theft, destruction, alteration, unauthorized access to entries, or entries that are lost, damaged, or delayed due to server issues, technical malfunctions, viruses, bugs, or other factors beyond the organiser’s control.  
  • The organiser reserves the right to amend the terms and conditions, as well as terminate the competition, at any time. In the event of such termination, all entrants agree to waive any rights that they may have in terms of the competition and acknowledge that they have no recourse against the organiser, its affiliated entities, and their directors, employees, and agents and independent competition partners.  
  • The laws of the Republic of South Africa will govern the Competition Rules, and any and all disputes will be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.  
  • The names of the prize winners will be published on the organiser’s and independent competition partner’s social media platforms.  
  • The winner may be requested to take part in the organiser’s publicity campaigns or to allow their names and likenesses to be used by the organiser for promotional purposes.   
  • The organiser will oversee the competition, and all decisions regarding any aspect of the competition, including the selection of prize winners, are final. No correspondence or discussions will be entered into.  

PROTECTION OF PERSONAL INFORMATION

Personal information collected during the competition will only be used for purposes directly related to the competition. The organiser undertakes not to share, sell, or misuse personal information and to ensure its security. Participants may withdraw their consent to data processing at any time, but such withdrawal may affect their participation in the competition where such data is necessary for prize allocation or communication.
